Functions Available Within the Service 4.1. Within the framework of the Service, the Service Provider offers the following functionalities: • Creation of User Profile: Registered Users may create a personal profile and upload photo(s). Users may add friends and follow the profiles and updates of other Users. • Messaging: Registered Users may send messages to friends, other Users, and pet-related businesses. • Creation of Pet Profile: Registered Users may create profiles for their pets inside their own User Profile and upload photos per pet profile. Pet profiles are intended for voluntarily recording pet information visible to other Users who visit the User’s profile. With the Free Profile, the User may send messages to any other registered User; however, the messaging functionality is limited. • Finding Missing Pets: the User may report in the Application and on the Website which pet has gone missing, where and when the pet was lost, the expected behavior of the missing animal, and may also provide any other relevant information to facilitate promptly finding the pet. Based on the report, the Application/Website marks the last known location of the missing pet on the map available through the Application/Website (using the Google Maps API), which may also be viewed by other Users. Users who have seen the missing animal may submit a report accordingly. • Reporting Stray Animals: The User may report in the Application and on the Website where and when they saw a stray animal, what type of stray animal was observed, upload a photo of the animal, and provide additional relevant information in order to facilitate the prompt identification of the animal’s owner and the timely rescue of the animal. Based on the report, the Application/Website marks the last known location of the reported stray animal on the map available through the Application/Website (using the Google Maps API). • Volunteer Animal Rescue Assistance: Users may apply through the Application and the Website to become volunteer animal rescue helpers. Subject to the User’s consent, Users who have registered as volunteers and are located near the reported stray animal will receive a notification. Following such notification, the volunteer User may indicate their availability to participate in the animal rescue. Users who have indicated their availability for the rescue will be placed into a shared messaging group, where they may coordinate the rescue of the stray animal. • Adoption Support Database: Foundations and other Users may upload animals available for adoption. Within the Database, Users may search based on parameters specified by them, including animal type, distance, location, and other characteristics. Users may click on the animal profiles to view which NGO the animal is associated with and may contact the respective organization through the chat function. • Temporary Foster Applications: Users may voluntarily apply to become temporary foster caregivers for ownerless pets — including lost and found animals and animals placed in shelters — for the purpose of providing temporary care and supervision. Within the scope of this function, the Service Provider exclusively provides an online platform enabling communication and contact between Users and animal shelters. Temporary foster caregivers may apply under the conditions determined by the relevant animal shelter and at their own responsibility. The duration of the temporary fostering period and the allocation of related costs shall be determined by the animal shelter. The Service Provider is not a party to any legal relationship established between the animal shelter and the User in connection with temporary fostering activities and shall not be liable for the performance thereof or for any damages arising in connection therewith. • Creation of Business Profiles: Following the registration of a personal profile, Users may create a Business Profile in which they may display the services, opening hours, and other characteristics of the pet-related business they officially represent pursuant to law or any other legal basis. The purpose of the Business Profile is to connect businesses providing services related to pets and pet-friendly hospitality venues with pet owners seeking services for their pets. Certain Business Profile functionalities are available only with a subscription. • Pet-related Business Search: Users may search through a map-based search function for businesses providing services for pets, including veterinarians, pet groomers, pet boarding facilities, hotels, pet stores, breeders, and other businesses that accommodate animals (such as restaurants and hotels). Users may also publish reviews regarding individual pet-related businesses. • Pet-related Business Reviews: Users may publish ratings and reviews regarding Business Profiles and related services. Reviews may only be published by Users who have actually interacted with the relevant Business Profile or used its services. The publication of false, misleading, manipulated, or third-party-generated reviews, as well as any artificial manipulation of the review system, is strictly prohibited. The Service Provider does not conduct prior monitoring of reviews, and sole responsibility for the content of any review rests with the User publishing it. The Service Provider reserves the right to remove or restrict reviews that violate these GTC, applicable laws, or the principles of good faith and fair dealing. A negative review alone shall not constitute grounds for removal. Complaints relating to reviews may be reported to the Service Provider, which shall be entitled to review the relevant review. • Pet-related Business Event Search: Users may view events and temporary offers published and organized by individual pet-related businesses and may also register for such events and offers. 5. The Application is available free of charge, without registration, to any User not excluded under these GTC; however, without registration only limited content and limited functionalities are available both in the Application and on the Website. 5.4. Upon registration, an indefinite-term service agreement is concluded between the User and the Service Provider, granting the User access to the functionalities of the Application and the Website that are not subject to subscription. Following the provision of the registration data, a condition of registration is that the User familiarize themselves with and acknowledge the provisions of these GTC as binding upon themselves. During the registration process, by actively selecting the relevant checkbox, the User expressly declares that they have read and accepted the provisions of these GTC as legally binding. 5.5. The User Account created through registration serves the purpose of recording certain data and characteristics of the User and managing the account. The User undertakes to update any changes to their data in their User Account (profile). 5.6. The User may terminate their registration at any time within their User Account by clicking the “Delete” button. The Service Provider hereby informs the User that deleting the Application itself does not terminate the User Account. Upon deletion of the registration, all subscriptions shall also terminate on the last day of the relevant subscription period. Personal data shall be deleted in accordance with the provisions of the Privacy Notice. 5.7. Registration shall also terminate upon deletion by the Service Provider or if the Application is made unavailable by the Service Provider. Upon deletion of the registration or the User Profile, as well as upon the Service Provider making the Application unavailable, the Agreement shall terminate. 5.8. The Application may only be used with software installed on the User’s mobile device, including in particular the operating system and internet browser, and certain functionalities of the Application require an active internet connection. The User shall maintain their device in a condition suitable for the proper use of the Application. The Service Provider does not provide any support or equipment for this purpose. The costs of the Application, other software, and the internet connection shall be borne by the User. The Application is compatible with iOS 15.1 and Android 12 operating systems and with later versions thereof. 5.9. The Service Provider aims to provide Users with a stable, accessible, and up-to-date user experience; therefore, the Service Provider shall be entitled at any time to temporarily suspend the provision of the Service for the duration necessary to carry out maintenance and software or content updates of the Application and/or the Website. 5.10. The Service Provider aims to continuously expand the services available to Users, and the rules governing such expanded services shall be set out in the GTC effective at the time the relevant update is downloaded. By downloading a software update of the Application, the agreement concluded between the Service Provider and the User under these GTC shall be amended in accordance with the version of the GTC effective at the time of the update download. Following the download of the update, the User expressly accepts the amended provisions of the GTC by actively selecting the relevant checkbox displayed in the Application and on the Website. 5.11. The Service Provider shall be entitled to suspend the provision of and access to the Service if required by applicable law or a court decision, or if the Service is used in a manner contrary to these GTC, without authorization, contrary to its intended purpose, or otherwise unlawfully. 6. User Profiles: Free Profile, Business Profile, Business Profile Premium 6.1. Free Profile 6.1.1. The profile created through registration is free of charge (Free Profile). The Free Profile provides limited access to functionalities. 6.1.2. The Free Profile allows the creation of up to 2 Pet Profiles and provides limited messaging functionality. 6.2. Business Profile 6.2.1. A Business Profile is a user profile that may be created and used within the Application and on the Website by pet-related businesses. 6.2.2. Business Profile registration may be initiated from the personal profile of a User authorized to represent the relevant pet-related business, in accordance with the information available in the Application and on the Website. During the registration process, the User must prove their authorization to represent the relevant organization by uploading a company registry extract, specimen signature, or other credible supporting documentation. By actively selecting the relevant checkbox during registration, the User registering the Business Profile expressly declares that they are duly authorized to represent the pet-related business they intend to register. 6.2.3. The Business Profile enables, in particular: • the display of the business’s or organization’s information; • the publication of services, events, and related information; • map-based visibility within the pet-related business search function; • communication with other Users; • receiving reviews and ratings; • the use of additional Business Profile-related functionalities available in the Application and on the Website. 6.2.4. Business Profile functionalities are available only to a limited extent under the free Business Profile. With a free Business Profile, the pet-related business may display its name, opening hours, address, and website within the Business Profile, and may mark its business location on the map available in the Application and on the Website. 6.2.5. A User authorized to represent the pet-related business may assign additional Users to manage the Business Profile and may also revoke such assignments. 6.3. Business Profile Premium 6.3.1. Certain Business Profile functionalities are available only upon subscribing to Business Profile Premium. The Business Profile Premium subscription is an automatically renewing 30-day subscription. The minimum term of the subscription service agreement is 30 days. Upon payment of the subscription fee for the first time, the User subscribing to Business Profile Premium — being a User authorized to represent the pet-related business operating the Business Profile — expressly consents to the Service Provider automatically charging the applicable subscription fee to the provided bank card on a recurring basis every 30 days until the subscription is cancelled prior to the next renewal date. 6.3.2. With a Business Profile Premium subscription, the User may upload photos and a detailed business profile, highlight their pet-related business on the map available in the Application and on the Website, feature their pet-related business in search results, directly send and receive messages to and from other Users, create events within their Business Profile, and respond to reviews submitted by Users. 6.3.3. The Business Profile Premium subscription may be initiated within the Application and on the Website following the registration of a Business Profile. The subscription commencement date shall be the date on which the User completes the first subscription payment. In connection with the first successful payment of the subscription fee, the Service Provider shall send an automatic confirmation to the User, which shall be available within the User Profile both in the Application and on the Website. 6.3.4. The Service Provider shall clearly and comprehensibly display the applicable subscription fees on the relevant interfaces of the Application and the Website, including information relating to VAT. When ordering the Subscription, the User shall always be obliged to pay the subscription fee in effect at the time, as displayed on the Website and in the Application. Subscription payments may be made by bank card through the Stripe payment service provider system in accordance with the information provided in the Application and on the Website. The Service Provider shall not have access to or process the User’s bank card details. 6.3.5. The User acknowledges that the subscription fee becomes due on the first day of each applicable subscription period, and the Service Provider shall automatically attempt to charge such fee to the bank card provided by the User through the Stripe payment service provider. If the Subscription Fee is not successfully paid due to a failed transaction or for any other reason, the Service Provider shall be entitled to suspend the provision of Business Profile Premium services and access to related functionalities, and shall promptly notify the User of the unsuccessful charge while simultaneously granting an additional payment period of at least 5 days to settle the outstanding fee. If the User fails to pay the subscription fee within the additional deadline, the Service Provider shall be entitled to terminate the Subscription with immediate effect. Such termination shall not have retroactive effect with respect to any subscription period already paid for. 6.3.6. The Service Provider shall log data related to the subscription, including in particular the subscription-based User Profile, the commencement date of the Business Profile subscription, and the fact and time of the confirmation being communicated. 6.3.7. The Service Provider reserves the right, with respect to the Subscription, to determine and modify the monthly subscription fee in any reasonable manner in order to reflect changes in circumstances, including, but not limited to, changes in the range or functionality of services offered, changes in business operations, or changes in the economic environment, as well as for security, legal, or regulatory reasons. The Service Provider shall notify the User of any modification to the subscription fee at least 15 days in advance. If the User does not accept the modification, they shall be entitled to terminate the subscription free of charge until the effective date of the modification. 6.3.8. The User may terminate the Subscription both in the Application and on the Website by clicking the Cancel Subscription button within their User Profile. The termination shall take effect at the end of the ongoing subscription period; the subscription fee already paid for the current period shall not be refunded, unless otherwise expressly required by law or expressly stated otherwise by the Service Provider. Upon termination of the subscription, access to the functionalities provided under the Business Profile Premium subscription shall also cease, and the account shall revert to the free Business Profile. Deletion of the Business Profile shall result in the termination of the subscription at the end of the current subscription period. 6.3.9. Upon activation of the Business Profile Premium subscription, the Service Provider shall make the services related to the Business Profile immediately available. By activating the Business Profile Premium subscription, the User expressly requests the commencement of the performance of the service and acknowledges that, given that the subscription constitutes a unified digital service that is not divisible into separate parts, the User shall lose their right of withdrawal once performance of the service has commenced. 7. Copyright and Intellectual Property 7.1. By downloading the Application, a license agreement is concluded between the Service Provider and the User regarding the free use of the Application, pursuant to which the User acquires a one-time, limited, non-exclusive right to use all copyrighted works, software, and databases available within the Application and on the Website in accordance with the provisions of these GTC. The right of use granted hereunder shall terminate upon deletion of the Application and/or the registration. 7.2.
